mCare Health Privacy Policy

This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

From now on, this privacy policy can provide privacy details as for how we manage your personal information when using mCare Health and all devices and services connected to mCare Health.

Please read the following terms carefully before using mCare Health products and services:

  The ownership and interpretation of mCare Health products and services shall remain with mCare Health. If you use this service or complete the registration process, you acknowledge or accept all of these terms.

  Users shall provide authentic personal information. If the personal information provided is inaccurate, mCare Health will not be responsible for the inaccurate data based on inaccurate information analysis.

 

Special instructions

The content of the service provided by mCare Health is only an auxiliary reference for users to exercise and understand their own conditions, which cannot be used for medical purposes. If you have any discomfort, please consult a doctor. mCare Health is not responsible for any direct or indirect damage. The service content of mCare Health is for general reference only and may not be suitable for specific users, especially for:

 

(1) People with a history of heart disease, stroke, high blood pressure, hyperlipidemia, diabetes, asthma and other circulatory and respiratory diseases.

 

(2) mCare Health shall be responsible for insufficient food intake, weight loss or weight gain, fainting, malnutrition or other consequences resulting from calorie consumption after wearing a mCare Health wristband or watch.

(3) Although the mCare Health wristband or watch can monitor heart rate, blood pressure, blood oxygen, body temperature, sleep quality, athletic ability, etc., it cannot be used for any medical purpose. Consult your doctor before starting any exercise and diet plans.

mCare Health believes that transparency is the key to maintaining any healthy relationship, and we are serving for health whole-heartedly. Thank you for your trust in us and for providing us with your important information. We will also be transparent about how to use your information.

Privacy practices for our devices, applications, software, websites, API, products and services are described here. You will learn about the data we collect, how to use the data, the measures we endow you to control your information, and the security measures we take. Specific details include:

Definitions

·         Service

Service is the mobile application operated by Green Net Design Inc.

·         Personal Data

Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

·         Usage Data

Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

·         Cookies

Cookies are small files stored on your device (computer or mobile device).

·         Data Controller

Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed.

Location Data

We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customise our Service. You can enable or disable location services when you use our Service at any time by way of your device settings.

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service. Green Net Design inc. may process your Personal Data because:

If you are located outside and choose to provide information to us, please note that we transfer the data, including Personal Data, to and process it there.

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

·         The right to withdraw consent. You also have the right to withdraw your consent at any time where Green Net Design Inc. relied on your consent to process your personal information.

1. The information we collect

To provide better services, we need you to provide your personal information for the necessary services. If you do not provide personal information, we may not be able to provide you with our products or services.

When you use our services, we will collect the following types of information

 

Your information:

We may collect and use the mobile number you used when creating an account on our services the name, email address, date of birth, gender, height, weight data provided by your  account when you use a third party to log in, or you may choose to provide other types of information (profile photo, resume, country information and community user name). If you do not provide such information, the accuracy of motion data calculation will be affected.

Data recorded by the device:

When you use mCare Health to synchronize data from related devices, we record personal information (birthday, height, weight, gender), activity information(steps, calories), sleep (sleep length, sleep quality), heart rate (recent heart rate, average heart rate), blood oxygen saturation (SpO2, recent blood oxygen, blood oxygen range), temperature (maximum temperature, lowest temperature, average temperature), body weight, pace, exercise time. If you do not provide such information, you will not be able to save exercise data in the cloud. When you uninstall the application or change your device, it will result in the loss of sports health data, but this will not affect your local use of the sports health data recording function.

 

 

Behavior labelling information:

When you choose to label related behaviors, mCare Health will collect activity information and heart rate data to provide you with corresponding service labelling function. 

 

File information:

When you connect our device, the device needs to update the version or font. With your permission, the device upgrade file, the font upgrade file will be downloaded. The pictures you need to share are cached and the local pictures are chosen when changing the avatar. 

 

Incoming call information:

When you connect our device and use the incoming call and SMS reminder function, mCare Health will obtain the data of incoming calls, SMS, address book and monitoring the status of mobile phone calls. With your permission, the data of incoming calls, SMS and address book will be used for the display of wristbands and watches, but mCare Health will not save data related to your calls, SMS and address book.

 

Mobile phone information:

When you use mCare Health, we need to obtain your mobile phone operating system version, mobile phone brand model, mobile phone hardware identifier (IDFA\ IMEI\ IMSI\ UUID\ MAC), and mobile phone system time to meet the matching device function, incoming call function, push function and abnormal problem analysis needs.

 

Address book information:

When you use the leaderboard and the people you care about function, you can upload your address book information to achieve the contact matching function. We will use the address book information you upload as the basic information of your care people, but the mCare Health server will not Store the uploaded phone number information.

 

Network usage data:

We may collect network type (2G\ 3G\ 4G\ 5G\ WIFI) and network signal information related to specific functions of mCare Health.

 

Mobile phone software installation list information:

We may obtain your software installation list information. With your permission, we will synchronize your health data to the third-party software you choose for display or third-party software information to the device for display.

 

Music control information:

When you use the music control function, we will collect the music information (song name, album name, singer, play theme, song status) from your phone and synchronize it to the device. This information is only displayed on the device, and we will not store the aforementioned information.

 

Location information:

When you use location-based program services or functions, we may collect your location information (weather data, since Android6.0, App requires positioning permission to scan Bluetooth devices, use gps to record your trajectory in movement).

 

Feedback:

When you submit relevant feedback, the relevant user feedback log, contact information and user name information will be collected based on your choice.

 

Equipment information:

When you use mCare Health to connect to our hardware device, the device unique identifier Mac address, firmware version, approximate geographic location data (non-personal data) and related function usage statistics (non-personal data) will be transmitted to the server. The above data collection may also apply to your updated system or software and reset.

 

The information you submit proactively when using the relevant functions:

You have set goals and heart rate reminders in mCare Health, and your self-filled exercise goals and weight targets, and heart rate reminders will be collected so that you will be prompted or warned when the goals are reached. If you choose to use the female health function, the number of days of menstruation that you voluntarily fill in, the number of days between the start of two menstruations, the start date of the most recent menstruation, the start date of menstruation, the ending date, the physical condition and mood during the menstruation submitted each time during the use of this function will be collected; you can choose to make your own dial, and the pictures you upload will be collected by us as your dial background.

 

Data of relatives and friends:

When using the function of people you care about, you can choose to add other users as your relatives and friends. With their authorization, the data related to your relatives and friends (exercise data, sleep data, weight data, temperature data, blood oxygen data) will be used to show to you. You can contact friends on the server or invite friends who have not yet joined by providing an email address, visiting a social account, or using the address book on your phone. We will not store your address book, and will delete it immediately once the address book is added as friends. If your relatives and friends do not provide such information, you will not see their data in the people you care about.

 

Album information:

You can upload your photo to realize the function of changing your avatar and supplementary explanation of the question in the online feedback function. We will use the photo you uploaded to include the evaluation of your uploaded picture and supplementary explanation of the question in the online consultation function , In order to facilitate you to share videos and pictures, you need to access your phone album permissions

 

Sensor information:

When using the sensor, you can directly turn on the indoor motion mode of the phone in mCare Health and display your exercise results.

 

Extraneous information:

To help improve your experience or enable some functions of the service, you can choose to provide us with more information (meals, weight, sleep, drinking water or female health tracking logs; reminders; and messages sent to friends on the discussion board or to friends on the service.

 

Information provided by the third-party service:

If you connect your account on the service to an account on another service, we will receive information from other services. If you connect to your Facebook or Google account, we will receive information such as your name, profile photo, age range, language, email address and friend list. You can also authorize us to access your exercise or activity data from other services. You can also unauthorized our access to other services and stop sharing information on other services. 

 

2. The way we use information

We use the collected information for the following purposes.

 

To set up a mCare Health account: when setting up an account through mCare Health, the information filled in will be used to set up your mCare Health account and display the relevant data in mCare Health.

To calculate or record exercise and health results: we use personal body data or device recorded data to calculate exercise and health results, which are used to show to you in the APP or device: BMI, steps, exercise trajectory, calorie consumption, heart rate data, sleep data, temperature data, weight data.

Physical condition analysis: based on the personal body data you provide and the data recorded by the device, we provide you with the analysis related to your physical condition for your reference. For example: to provide you with an ideal weight range for your reference.

Health data: In order to calculate health data more accurately, it is necessary to collect the user’s following information: personal name, birthday, gender, and personal phone number (sensitive information). If you refuse to provide this information, use the default values, which will affect the calculation accuracy of your health data.

To provide sports services: after the related device is synchronized with mCare Health, the data recorded in the device will be synchronized to mCare Health and displayed to the user.

Location services: When you allow us to collect accurate or ambiguous location information, we need the information to improve the function of the service, record sports locations or draw sports route maps, location-based weather services, and when you use BLE devices to scan, connect and record sports, we will need this information Obtain your device location authorization and collect the location information provided by you. 

To display incoming call or SMS message: when you receive an incoming call or SMS message, the data of the incoming call or message will be displayed on some devices that support this function, and the incoming call information can be answered and hung up directly using a wristband or watch.

Leaderboard function: When you use the ranking function, the phone information in your address book will be uploaded to the server for comparison and screening, and the sports ranking information will be shown to you.

Information reminder or third-party data access function: When you use the information reminder or third-party data access function, you can choose the software you want to use according to the information about the software installed on your mobile phone.

To display music information: when you use the music control function, some devices that support this function will display music information (song status, volume).

To provide alarm clock reminder function: we will collect the alarm clock information on your mobile phone. When you turn on your alarm clock, you will be timely reminded through the vibration of the device.

Photo scan code function: You can use some devices that support this function to control the phone’s taking pictures, and use this additional function to complete the functions of taking pictures and scanning codes. When you use your device camera to scan the QR code and take photos, we need to access the relevant permissions of your device camera.

To provide female health function: when you choose to use this function, you can record and view menstruation-related information on some devices that support this function or in mCare Health; we will predict your period and remind you based on the information filled in.

To display sleep information: we will use personal body data and device recorded data to calculate and analyze your sleep quality, which can be used to show to you in mCare Health, including sleep time, sleep length distribution and sleep quality.

To provide network-related services: mCare Health will prompt users whether a new version of mCare Health is available to update according to different network types (2G\ 3G\ 4G\ 5G\ WIFI) and network signal information.

Statistical analysis: we conduct a statistical analysis of our services or device conditions, and may share these statistics with the public or third parties. The data are used to reveal the usage trends of our products or services, optimize our products and services, and show you the list of people you care about, but these statistics do not contain any of your identity information.

To provide and maintain services: by using the information we collect, we can provide services to you and abide by our terms of service contract with you. We need to use your information to provide you with mCare Health control panels to track your exercises, activities and other tendencies; to achieve community functions of services; and to support you.

In order to achieve the community function of the service, we may use your information to help you find and contact other users, while letting other users find and contact you. Your account contact information allows other users to add you as a friend. When another user’s address book or your email address or mobile phone number pops up via a friend network connected to the service, we will display to the user that you are a user of the service. 

Analysis and statistics: we need to collect your device information, system basic information, device usage information, system usage information and the worn device usage information, including the pages and the buttons you click in the application, the functional operation of applications and device, which is used to analyze and calculate the use of device and applications. 

 

3. How to share information 

Except for the limited circumstances described below, we will not share your personal information.

When you agree or instruct us to share

You may instruct us to disclose your information to others while using social contact tools. For related information, we will provide you with privacy preferences and other tools in your account settings to control the information visible to other users on the service. Please note that if you choose to participate in the challenge, your avatar, messages posted, total steps in the challenge, personal statistics, and achievement information are not bound by your privacy preferences and will be visible to all participants.   

External processing

We will transmit the information to our company’s affiliated parties, service providers and other partners, who will process the information in accordance with our instructions as well as this policy and any other relevant confidentiality and security measures. These partners provide us with services globally, including customer support, information technology, sales, marketing, data analysis, research and investigation.

Sharing with third parties

The application “mCare Health” provides the function to share the collected data with other partners, including your personal basic information (height, weight), exercise health information (steps, exercise data, calorie consumption, blood oxygen, heart rate, blood pressure, sleep data), so that partners could provide corresponding services. Please read its privacy policy carefully in the third-party software before you enable the relevant services. mCare Health will not share user data with any organization or individual until it is expressly authorized by you. You can terminate the authorization of third-party services at any time.

mCare Health provides you with an open platform for sports health data across applications. It can provide data shared services to Health Kit with your authorization, and provide more abundant data for third-party services through Health Kit. In third-party applications that support Health Kit, you can log in to your account and expressly authorize third-party services to access your personal data in Health Kit. You can cancel the authorization in the third-party application. 

Legal reasons or to prevent harm

In order to comply with laws, regulations, legal procedures or government requirements; to assert legal rights or defend legitimate claims; to prevent, detect or investigate illegal activities, frauds, abuses, violations against our terms or threats to the security of services or the personal safety of any personnel, we may preserve or disclose your relevant information. 

Please note that in accordance with our policy, we will notify you of the legal procedures requiring access to your information, such as search warrants, court orders or subpoenas, except what are prohibited by law. If the court order stipulates a confidentiality period, we will give notice after the end of the confidentiality period. The exceptions to our notification policy include emergencies or situations that lead to a failure to achieve the desired goals, and emergencies that endanger life or cause serious personal injury.

 

We may share non-personal information that is summarized or unidentifiable so that it cannot be reasonably used to identify individuals. We can publicize such information and disclose it to third parties, in public reports on sports and activities, to our partners who have signed agreements with us, or as part of the community benchmark information we provide to subscribers of services.

If we participate in mergers, acquisitions or asset sales, we will continue to take measures to protect the confidentiality of personal information and notify the affected users before transferring any personal information to the new organization. 

 

4. Your right to access and control your personal information

Access personal information

After installing and logging in to “mCare Health”, the personal information you saved on the server will be automatically downloaded and synchronized to the local phone.

In the application “mCare Health”, you can access your exercise and health data through data cards, including step cards, exercise cards, sleep cards, heart rate cards, weight cards,  blood oxygen cards,and device pages.

You can view your nickname, profile photo, gender, date of birth, height, weight, BMI and my emblem on the “personal information” page.

 

Update personal information

You can modify and update your nickname, profile photo, gender, date of birth, height and weight on the “personal information” page, where data obtained automatically from your mobile phone or sports health device is not available for editing and updating.

 

Delete personal information

By unpairing, you can clear information about paired devices and shared device information from the cloud. Specific path: setting-device-unpairing

You can also clear all sports health and other service data bound to your account by logging out of your account. Specific path: setting-account center-cancelling the account

If you choose to log out of your account, please note that although most of the information will be deleted within 30 days, it may take up to 90 days to delete all information, data recorded by your mCare Health device and other data stored in our backup system. This is determined by the size and complexity of the system we use to store data. We may also retain data for legal reasons or for injury preventing purposes, including those described in the section on how the information is shared.

 

You can make a request to us to delete your personal information in the following situations:

1. If we handle the personal information in violation of laws and regulations.

2. If we collect and use your personal information without your consent.

3. If our handling of personal information violates our agreement with you.

4. If you no longer use our products or services, or if you log out of your account.

5. If we no longer provide products or services to you.

If we decide to respond to your deletion request, we will also notify the entities that have obtained your personal information from us and require them to delete in a timely manner, unless otherwise provided by laws and regulations, or these entities have your independent authorization.

 

Acquisition a copy of personal information

If you need a copy of your personal information, you can contact us through the means provided at the end of this Privacy Policy. Upon verifying your identity, we will provide you with a copy of your personal information (including basic information, identity information) in our services, except as otherwise provided for by laws and regulations or otherwise stipulated in this Policy.

 

Change the scope of your authorized consent

Each business function requires some basic personal information to be completed. You may give or withdraw your authorization at any time for the collection and use of additional personal information.

If you want to change the authorization of relevant permissions (location, address book, camera, album, microphone, storage, phone, SMS, pedometer, battery-optimized whitelist, reading notification), you can do so in the permission settings interface in app. Specific path: setting-help-permission settings. You may also permanently withdraw our authority to continue to collect your personal information by logging out of your account. If you encounter operational problems during this process, you can contact us through the contact information provided at the end of this Privacy Policy. When you withdraw your consent, we will no longer handle the corresponding personal information. However, your decision to withdraw your consent will not affect the previous processing of personal information based on your authorization.

 

Automatic decision-making of constrained information system

In some business functions, we may only make decisions based on unartificial automatic decision-making mechanisms, including information systems, algorithms, and so on. If some decisions significantly affect your legitimate rights and interests, you have the right to request an explanation from us, and we will provide appropriate remedies.

Object to the use of data

We provide you with account settings and tools to control our use of the data. Through privacy settings, you can restrict how your information is revealed to other users on the service; through notification settings, you can restrict the receipt of notifications sent by us; and under application settings, you may revoke access permissions to third-party applications that are previously connected to your mCare Health account. You can also use the mCare Health app to unpair your device from your account at any time. 

If you dwell at a designated country, in some cases, you may object to our processing of your information based on our legitimate interests, including those described in the section on how the information is used. You have the right to object to the use of your information for direct marketing purposes. Please refer to your notification settings to control the marketing information we provide to you on mCare Health products.

 

Restrict the use of data

5. Data retention

The personal information collected and generated during our operations in Canada will be stored in the data center in the Canada region.

As long as your account is extant, we will reserve your account information, your name, email address and password, as we need such information to operate your account. In some cases, when you provide us with information on service function, we will delete data no longer needed by that function. When you provide a contact list for finding friends on the service, we will delete it after we use the list to add the contact as a friend. We will retain additional information, exercise or activity data until you use your account settings or tools to delete the data or accounts, as we use these data to provide you with personal statistics and other services. We will also retain information about you and your use of the service in accordance with legitimate commercial interests and for legitimate reasons to prevent harm, including what is described in the section on how our information is used and how it is shared. If you delete your personal information or cancel your account acting on your own, we will retain your existing personal information in accordance with the shortest period possible stipulated by laws and regulations. Within the shortest retention period required by laws and regulations, we will no longer commercialize your personal information, and when your personal information exceeds the above retention period, we will anonymize it.

The mCare Health products and services you use, which may include third-party products and services, analysis and statistics, social contact sharing, map services, push services, security services. Some of them will be provided as links to third-party websites, while others will be accessed in the form of SDK or API. It is also possible to collect your information when you use these products or services. Therefore, we strongly recommend that you take time to read the third party’s privacy policy, just as you read ours.
